You can terminate a registered partnership through the court or through an agreement at a notary.
Terminate a registered partnership
You can terminate your partnership in 2 ways:
Through a court ruling:
- When only 1 of the partners wants to terminate the partnership.
- When the partners have custody of 1 or more (underage) children. Joint custody is not required.
Through a ‘termination agreement’ at a lawyer or attorney:
- When both partners want to terminate the partnership.
How does the termination of registered partnership work?
Through a court ruling:
- You go to a lawyer or attorney.
- Is the ruling irrevocable? Then you or your lawyer must request the municipality to register the ruling within 6 months.
Let op!
Please note: after this period you can no longer register the ruling and it will expire.
Through a ‘termination agreement’:
- You have a lawyer or notary draw up a termination agreement.
- The lawyer or notary draws up a statement that a termination agreement has been made.
- You or your lawyer or notary must request the municipality to register the agreement. This must be done within 3 months after the agreement has been made. After this period you can no longer register the document and it expires.
Your partnership is officially terminated when:
- the legal ruling has been registered at the Registry Office. It can only be registered after the ruling has become irrevocable.
- the municipality has registered the termination agreement at the Registry Office.
Fees
There are no costs for registration. There will be costs for a lawyer or notary.
How long does it take?
Have you submitted the document to the municipality? Then it will be registered within 1 week.
