Request to keep data confidential

Would you prefer that companies and private individuals are not able to access your personal details in the GBA? Then you may submit a request to keep your data confidential.

What is it?

The municipality sometimes shares your personal details with government and social agencies such as pension funds, which use the information to carry out their legal duties.

The municipality will never provide information without your permission to:

  • private individuals
  • commercial institutions

Do you object to your personal details being shared with other parties? Then you may ask the municipality to keep your data confidential. This means your personal details will not be shared with:

  • non-commercial institutions such as sports clubs and music societies
  • the Foundation for Interdenominational Membership Administration (Stichting Interkerkelijke Ledenadministratie or SILA), which manages the membership records of religious denominations
  • foundations with a social function.

What are the conditions?

All citizens are entitled to privacy. This is why the municipality will always comply with your requests to that end.

  • Data for government institutions

The police, public prosecution service and Inland Revenue Department (Belastingdienst) may request access to your personal records, as can other government bodies or agencies with a public law duty. In that case the municipality is obliged to provide the information requested. The Ministry of the Interior and Kingdom Relations determines what kind of information may be released.

  • What are mandatory third parties?

Mandatory third parties are institutions or individuals which need access to the correct personal records to be able to carry out their legal duties. This could be a bankruptcy trustee, for example, or a lawyer.

If you have asked for your personal data to be kept confidential and a ‘mandatory third party’ requests access to your records, the Municipal Executive will weigh your interests against those of the applicant. Before the Municipal Executive approves the third party’s request to access your records:

  • You will be informed of the request in writing.
  • You may submit a letter of objection with the Municipal Executive. (You will have 4 weeks in which to do so).
  • Your details will not be shared during this appeal period.
